Depending on the circumstances, a marina may have a duty to care for a boat owner’s vessel. Now, if the agreement between the parties is simply for a space or slip, then the marina has a duty to provide security, and keep the dock and mooring components in good condition. However, if the vessel is in dry rack storage or is given over to the care of the marina, then the marina is to keep the vessel in a secure condition.
It is important for all the parties to understand the slip, storage, or dockage agreement so that the rights and responsibilities of each is known. For example, some agreements contain disclaimers that reduce liability of the marina.
